LOOK OPTIC, LLC’s. d/b/a LOOK (“we”, “our” or “us”) is dedicated to protecting your data privacy and safety. We want to be completely transparent about how we use your data. LOOK’s policy explains what data we collect about you, why and how we use it, as well as how we share and manage your information. It also provides your choices and rights regarding this data, so please read this policy carefully so you are fully informed.

 

CATEGORIES OF INFORMATION LOOK COLLECTS

When you visit our Site and use the Services, we receive information about you from various sources, including when you (1) register for the Site and the Services by creating an Account (“Account”); (2) use the Services in general; and (3) use third party websites and services.  The information we collect fits into three categories: (1) Aggregated Non-Personal Information, (2) Personal Information, and (3) information collected by Cookies, Web Beacons and other Technology, all of which you voluntarily provide when you visit our Site or use the Services.

Aggregated Non-Personal Information: The statistical information we collect about how both unregistered and registered users, collectively, use the Services is called Aggregate Non-Personal Information.  Aggregate Non-Personal Information does not uniquely identify an individual or groups of individuals. It is maintained by us in the aggregate, so we do not know the identity of any particular user or groups of users. Regardless of your browser’s “Do Not Track” setting, to improve your website experience, we may monitor how many users visit our website, how many use mobile devices access our website, how users navigate through our website, a user’s Internet Service Provider, and which Internet browsers are used to access our website. This statistical information is not Personal Information and cannot be tied back to you, your Account or your web browser.

Personal Information: Personal Information means any information whether used alone or in combination with other information that can be used to identify, contact or locate an individual or groups of individuals.  It includes personally identifiable information like your first name, initial, or last name, home address and telephone number, government issued identification numbers, bank routing and accounting numbers, email addresses, user names, passwords, security question answers, and customer service account numbers.  This Privacy Policy also covers our treatment of any Personal Information that our business partners share with us or that we share with our business partners. We gather that kind of information when you use or access the Site and the Services.

You may elect to receive text messages from us. When you sign up to receive text messages, we will send you information about promotional offers and more. These messages may use information automatically collected based on your actions while on our sites and may prompt messaging such as cart abandon messages.  To the extent you voluntarily opt to have Text notifications sent directly to your mobile phone, we receive and store the information you provide, including your telephone number or when you read a text message. Data Collected by Third Parties:  This Privacy Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third party websites, services and applications that you elect to access through the Site and the Services or to individuals that we do not manage or employ. While we attempt to facilitate access only to those Third Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third Party Services. We encourage you to carefully review the privacy policies of any Third Party Services you access.

Virtual Mirror (FITTINGBOX)

This data privacy policy (the « Policy ») applies to the virtual try-on (VTO) solutions - and their optional add-on if any - published by FITTINGBOX, solely. This Policy does not apply to third-party websites and/or services, whether such websites and/or services could be accessed directly or indirectly from or by using the VTO solutions published by FITTINGBOX.

When you use these VTO solutions, FITTINGBOX may operate a scan and/or a reconstruction and/or a change in the appearance of your face but will not disclose or store your image: your image is processed live, only for the duration of the virtual try-on experience. FITTINGBOX will not sell, distribute, lease or otherwise disclose or store your personal data or your image. If you ever save a screenshot of your try-on, the image will be stored on your device only and FITTINGBOX cannot access it.

However, because we value your privacy, if FITTINGBOX ever were to come into the possession of personal data and/or biometric information / identifiers as part of this process, it would permanently destroy any such data and/or information when the initial purpose for collecting or obtaining such identifiers or information has been satisfied or within 30 days of an individual’s last interaction with us, whichever occurs first. By using such VTO solutions, you hereby agree to give access to your webcam to make a virtual try-on (VTO) experience and release FITTINGBOX from any liability whatsoever under the applicable data protection laws and regulation, with the European Regulation 2016/676 of 27 April 2016 (GDPR), the EU-U.S. and Swiss-U.S. Privacy Shield, the US Health Insurance Portability and Accountability Act of 1996, the US Health Information Technology for Economic and Clinical Health of 2009, the US CCPA of 2020, and with the Illinois' Biometric Information Privacy Act of 2008, as applicable, and any similar laws.

Please note also that data or cookies might be locally saved on your computer; If you are uncomfortable regarding cookies use, you can decline or disable or delete cookies on your computer by changing the settings in preferences or options menu in your browser. Please note that any declination or disabling or deletion of cookies may result in degraded operation of FITTINGBOX’s VTO solutions and/or the website or the device where such VTO solutions may be implemented; in no event will FITTINGBOX be liable for such degraded browsing or malfunction and their consequences.

This Policy may be modified from time to time at any by FITTINGBOX, at its sole discretion. Such modifications and updates shall be effective as soon as they are released. If you are not comfortable – or not comfortable anymore – with this Policy and/or any of its further amendments, please do not use.

Cookies Web Beacons, Pixel tags and Clear GIFs: We also use “cookies” and analogous technologies such as web beacons, JavaScript, pixel tags, locally shared objects, and clear GIFs to collect data on pages you view on our site, as well as to power the delivery of re-marketing and promotional offers.

Cookies: A “cookie” is a small bit of record-keeping information that websites often automatically store on a user's computer. Our cookies do not collect or Personal Information.  We do, however, use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your Account if you have one. Typically, cookies are used to quickly identify your computer or mobile device to “remember” you.

Web Beacons, pixel tags and clear GIFs: A web beacon, JavaScript, pixel tag, or clear GIF is an electronic image allowing us to count users who have visited certain pages on our website. Web beacons, like cookies, do not collect Personal Information.

 

INFORMATION LOOK COLLECTS AND WHY

When you shop online with LOOK, we collect the following data. This information is necessary to collect payment, process & ship your order, and to communicate order status.

- Email address
- Name
- Username and password
- Shipping Address
- Phone number
- Payment-related information

You have the option during checkout to create an account with LOOK. If you choose to create an account, we will create a profile containing your order history for your and our benefit. All of your order history is stored within our system.

When you sign up, we also ask for your email address so we can send you our newsletter and other marketing messages.  

You can choose to stop receiving LOOK emails at any time by clicking “unsubscribe” at the bottom of any LOOK marketing email.

When you contact LOOK via email or phone, we will ask for information to identify you in our system. This is needed to provide timely assistance. We may also ask for your feedback in shopping or communicating with us to improve our services.

When you visit LOOK online, the following technical information will be collected to protect your data and our website. We also use this information to improve your shopping experience, as well as the products and services LOOK provides.

- IP address
- Your browser type
- Your operating system
- Your browse behavior on our website, such as product pages visited
- Shopping behavior on our website, utilized for delivery of marketing and promotional offers

California “Do Not Track” Disclosure:  Most browsers are programmed to accept cookies or other similar technologies, but have an option to turn off the cookie feature. Depending on the sophistication of your browser, it may also give you the option to be notified you when you receive a cookie and an opportunity to accept or decline it.  Declining a cookie, or similar technology, may affect your ability to use certain features on our Site. You may stop accepting cookies from a particular website, or by changing your browser’s settings, which are usually found in the “options” or “preferences” menu. We do not collect Personal Information about your browsing habits over time and across third-party websites or online services. However, our website contains links and icons to other websites, including social media sites, and we do not control their collection or sharing of information about you. Refer to the below Linked Websites and Online Web Services section for more information.

 

ADS ON OTHER SITES

If you choose to give other sites your data (such as Google, Facebook, and Instagram), their rules apply to that data, not ours. We may have already or may in the future purchase ads on these sites, so if you have provided them with your data, then you will likely see our ads on these sites. If you do not wish to see these ads, you will have to contact the other sites directly.

 

WHAT WE DO WITH YOUR INFORMATION 

When you purchase something from LOOK’s online store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. 

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address, which provides us with information that helps us learn about your browser and operating system. 

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

We may share your data internally within LOOK. We may also share it with others who help us serve you. For instance, because we work with Shopify, we will share your data with Shopify and some supporting companies to help us process data, host our digital channels, process payments, send communications, fulfill orders, or provide us or you with services while shopping with us. These companies are required by law to protect your data and cannot use your data with the exception of helping us provide you with products and services or as allowed by the privacy law and our contracts.

Shopify Inc. uses a combination of data centers and cloud service providers to store your personal data in the United States and Canada. When personal data is transferred to the United States, it is either done so through the EU-U.S. and Swiss-U.S. Privacy Shield, for Shopify’s own storage, or through contractual data protection addenda (DPAs) with third-party service providers. The EU-U.S. and Swiss-U.S. Privacy Shields are also considered adequate under the GDPR. Shopify’s Privacy Shield certification statement can be found on PrivacyShield.gov.

 

HOW WE GET YOUR CONSENT 

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. 

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

 

AGE OF CONSENT 

By using this site and/or by accepting our policies, you represent that you are above the age of 16. If you are below the age of 16, then a parent or legal guardian must consent on your behalf. If we learn that we have collection any data for someone aged under 16, then we will delete it.

DISCLOSURE 

We may disclose your personal information if we are required by law to do so, to establish a legal defense in connection with a lawsuit, or if you violate our Terms of Service.

 

SHOPIFY 

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

 

PAYMENT 

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. 

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

THIRD-PARTY SERVICES 

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. 

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. 

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. 

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. 

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

 

SHOPIFY DISCLOSURES TO THIRD PARTIES

Shopify will never independently sell personal data for commercial purposes. However, Shopify does disclose personal data to third parties or allow third parties to access personal data to help provide services—for example, to:

- Store platform data
- Operate the forums and other portions of Shopify's website
- Respond to and manage support inquiries

Additionally, Shopify may provide personal data, where permitted to prevent, investigate, or respond to:

- Potential fraud
- Illegal conduct
- Physical threats
- Violations of any agreements with Shopify

Shopify also provides information to third parties when legally required to do so. Where Shopify believes it is legally required to provide information, and not legally prohibited from disclosing the existence of the legal order, it will notify the data subject and give the data subject a chance to seek a protective order.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

PROTECTING YOUR DATA 

Shopify is our data processing partner. To protect your personal information, Shopify takes reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. 

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. To keep your data safe, we ask you to pick a password when you create an account. You should avoid using the same password across sites or sharing your password information with anyone. Doing so makes your data vulnerable, and it’s very hard for us to protect you from another person’s breach.

Also, please note that LOOK will never ask for your password, so if you receive anything suspicious from someone pretending to be us, don’t give them your information.

 

COOKIES 

‘Cookies’ are small text files stored on your computer when you visit certain web pages. We use these important pieces of information to remember who you are when you come back and visit, keep track of what you have in your basket and tailor our website exactly to your needs.

Cookies do not store personally identifiable information such as name, address or payment details, but they do provide us with encrypted information to help improve your experience of the site. For example, they help us identify errors, suggest related products you may like when browsing and allow you to connect with social media sites such as Facebook, Instagram, Twitter and Pinterest. We do use other "third party" cookies who may also set cookies during your visit to be used for retargeting purposes. You always have the option of disabling cookies, but your browsing experience will be compromised. Cookies also do not cause harm to your computer.
